Welcome to Tadaima (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our rental listing platform, web applications, and related services (collectively, the “Service”).

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use our Service.

1. Overview

Tadaima provides an online platform that allows users to create, manage, and browse property listings for rent. We act solely as a platform provider — we do not own, manage, or guarantee any of the properties listed by users.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to use our Service. If you are using the Service on behalf of a business or property management company, you represent that you have the authority to bind that entity to these Terms.

3. Accounts

• Provide accurate and up-to-date information,
• Maintain the security of your login credentials,
• Accept responsibility for all activities under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or appear to be fraudulent.

4. User-Generated Content

Users may upload property listings, photos, descriptions, pricing, and other related information (“User Content”). By submitting User Content, you grant Tadaima a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content for the purpose of operating the platform.

• You own or have rights to the content you post,
• Your listings are accurate and lawful,
• Your content does not infringe on the rights of others.

We may remove or disable content that violates these Terms or applicable laws.

5. Content Moderation & Image Rights

We reserve the right to review, moderate, or remove content at our discretion, including:

• Misleading or fraudulent listings,
• Obscene, defamatory, or illegal material,
• Images or videos that violate privacy or copyright.

By uploading photos or videos, you confirm that you have the legal right to share them and that identifiable people (if any) have consented to their appearance.

You grant us a non-exclusive license to use such media for display and marketing of your listings within the Service. We may use AI-assisted tools to detect inappropriate or duplicate content to ensure a safe user experience.

6. Subscription and Payment

Some features of the Service (such as premium listings, analytics, or marketing tools) may require a paid subscription.

• Pay all applicable fees according to our pricing and billing terms,
• Authorize us or our payment processor to charge your payment method, and
• Acknowledge that payments are non-refundable, except as required by law.

7. Refunds & Cancellations

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of your current billing period.

Refunds are not automatically issued for partial periods, unused time, or early cancellations, unless required by applicable law. Contact support@tadaima.app within 7 days of a transaction if you believe you were charged in error.

We reserve the right to issue goodwill refunds or credits at our sole discretion.

8. Prohibited Activities

• Post false, misleading, or fraudulent listings,
• Upload viruses or malicious code,
• Scrape, copy, or reverse engineer the platform,
• Use the Service for illegal purposes,
• Harass or abuse other users.

9. Intellectual Property

All intellectual property related to the platform — including software, branding, and design — remains the property of Tadaima. You are granted a limited, non-exclusive, revocable license to use the Service in accordance with these Terms.

10. Data and Privacy

We process personal and listing data in accordance with our Privacy Policy. You retain ownership of your data but grant us the right to process it as needed to operate and improve the Service. We do not sell personal information to third parties.

11. Third-Party Services

The Service may integrate with third-party tools (e.g., payment processors, analytics, or cloud storage). Your use of those services is governed by their own terms and privacy policies.

12. Disclaimers

The Service and all content are provided “as is” and “as available.” We do not guarantee the accuracy of listings, the availability of properties, or the performance of any landlord, tenant, or third party.

13. Limitation of Liability

To the fullest extent permitted by law, Tadaima and its affiliates will not be liable for:

• Any indirect, incidental, or consequential damages,
• Loss of profits, data, or goodwill,
• Any claim exceeding the total fees you paid in the past 12 months.

14. Termination

You may delete your account at any time by contacting support@tadaima.app. We may suspend or terminate your access for violation of these Terms or if necessary to protect the platform or users. Upon termination, your license to use the Service ends immediately.

15. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Service. Your continued use after such changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of Canada, without regard to its conflict of law principles. All disputes will be resolved exclusively in the courts located in Province of British Columbia and the federal laws of Canada.
